1. Acceptance of Terms

By accessing or using Kindly Events ("the Platform", "we", "us", or "our") at https://mykindlyevents.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

These Terms apply to all visitors, users, event hosts, and guests who access or use the Platform.

2. Description of Service

Kindly Events is a charitable giving platform that enables event hosts to create campaigns where guests can direct donations to participating charities in lieu of traditional gifts. The Platform facilitates two campaign types:

  • Host Gifts (Host Pays): The host pledges a fixed donation amount, split proportionally across charities based on guest selections.
  • Guest Gifts (Guest Pays): Guests donate directly to their chosen charity via the charity's own donation page.

Kindly Events does not process, hold, or transfer charitable donations. All payments are made directly to charities through their own platforms.

3. User Accounts

To create and manage campaigns, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorised use of your account.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Campaign Creation and Host Responsibilities

As a campaign host, you agree to:

  • Only create campaigns for genuine events and charitable purposes.
  • Honour your pledged donation amounts for Host Pays campaigns and complete donations to the selected charities after closing a campaign.
  • Not misrepresent the nature of your event or the charities involved.
  • Ensure guest information collected through the Platform is handled responsibly and in accordance with applicable privacy laws.
  • Close campaigns in a timely manner once the event has concluded.

5. Charitable Donations

Kindly Events facilitates the selection of charities but does not guarantee, verify, or take responsibility for:

  • The tax-deductibility of any donation.
  • The charitable status or conduct of any listed charity.
  • The completion of donations by hosts in Host Pays campaigns (donations are honour-system based).
  • The processing of payments made directly on third-party charity websites.

Donors should verify the charitable status of any organisation before donating and consult a tax adviser regarding deductibility.

6. Prohibited Conduct

You agree not to use the Platform to:

  • Create fraudulent, misleading, or deceptive campaigns.
  • Collect guest information for purposes other than the stated campaign.
  • Violate any applicable local, national, or international law or regulation.
  • Transmit spam, unsolicited communications, or malicious code.
  • Attempt to gain unauthorised access to any part of the Platform or another user's account.
  • Use the Platform for any commercial purpose unrelated to charitable giving.

7. Privacy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your information as described therein. Guest email addresses collected through campaigns are used solely to send campaign-related notifications and are not shared with third parties for marketing purposes.

8. Intellectual Property

All content, trademarks, logos, and intellectual property on the Platform are owned by or licensed to Kindly Events. You may not reproduce, distribute, or create derivative works without our express written permission.

By submitting content to the Platform (such as campaign descriptions), you grant us a non-exclusive, royalty-free licence to use, display, and distribute that content in connection with operating the Platform.

9. Disclaimers and Limitation of Liability

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, Kindly Events shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, loss of revenue, or failure of a host to complete a pledged donation.

10. Indemnification

You agree to indemnify and hold harmless Kindly Events, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email or by posting a notice on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the public.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.
